Main Road Cleaning back e-mails photos Enforcement Notice To Council Press Reports
The management of main road cleaning in the Borough appears to be in a state of disarray. This is exemplified by dealings I have had with the Council relating to the north side of A40 between the border with Buckinghamshire and the beginning of the slip road up to the Swakelys Roundabout.
Failure to deal with fly tipping In February I drew the Council’s attention to some fly tipped rubbish behind the crash barrier . It had been there for several weeks. They claimed they were not responsible for its removal and passed my e-mail on to the contractor employed by Transport for London (TfL) claiming it was a maintenance issue. This apparently had been their practice for some years.
I checked with TfL and passed on to the Council their view that the Boroughs and not TfL are responsible for clearing fly tipping from London’s main roads (except where it is causing a safety hazard). The Council have accepted this view and subsequently took the appropriate remedial action. Needless to say the Council has not thanked me for pointing out the error of their ways..
Failure to clear litter In March I reported that this section was very badly littered. I said that I thought the Council’s litter pickers did not venture that far west. I was subsequently told that “the area had been added to our A40 programme”. When I pointed out that this implied that the Council had not been cleaning this area and were therefore in breach of the Environmental Protection Act I was told that the section had been “missed in error on the last litter pick”.
Throughout the Summer the volume of litter grew. Consequently on 24th September I gave the Council five days notice that I intended to ask the Magistrates Court for an order requiring them to clean this section of the highway under Section 91 of the Environmental Protection Act.
