Ref 3. Northwood Cemetery Remedial Work

In April 2008 I asked for copies of documents relating to a “winter works programme” (07/08) and “other remedial works” which LBH had said they had agreed with Enterprise plc,  a default notice issued to Enterprise plc and correspondence with Enterprise  recording that they had “made it clear to Enterprise that we are expecting a number of significant improvements in standards from 1st April 2008”

A copy of the default notice was only supplied after I submitted a formal complaint.  It took 60 working days compared to the statutory maximum of 20.

I did not  receive any documents relating to the winter works programme etc nor did I receive an unqualified statement as to whether  such documents were held, a breach of the Council’s statutory duty to “confirm or deny” .

Similarly, I have not been given copies of any correspondence with regard to the “significant improvements” nor have LBH clearly stated whether or not they hold such documents.

Having exhausted the Council’s complaints procedure I have  submitted  a formal complaint to the Information Commissioners Office.  The ICO wrote to LBH on 19th September asking them to conduct a internal review within 20 days.
